By accessing, registering for, or using Ecofleet’s platform, mobile applications, or related services(collectively, the “Services”), you agree to be bound by these Terms and Conditions and allapplicable laws and regulations. If you do not agree, you must not access or use the Services.
Ecofleet provides an electronic logging device (ELD) compliance platform designed to helpcommercial motor carriers and drivers comply with FMCSA regulations and improve operationalefficiency.The Services may include vehicle data collection, driver logs, GPS tracking, compliance reports,and integration with third-party systems.
3.1 Data We Collect
Ecofleet may collect, process, and store the following categories of information:
● Vehicle identification (VIN, unit ID, carrier name, etc.)
● Driver identification and account data
● GPS and geolocation data
● Engine diagnostics, speed, and odometer readings
● Duty status logs, compliance records, and driver behavior data
● Device and software usage information
● Billing and payment information
3.2 Data Sharing
By using Ecofleet, you consent to the collection and lawful sharing of your data with the followingparties and for the following purposes:
● Regulatory Authorities: Data may be shared with the FMCSA, DOT, state enforcementagencies, and other government authorities as required by law or regulation.
● Third-Party Service Providers: Data may be shared with technical partners thatsupport our operations, including hosting providers, cloud storage, customer support,and analytics services.
● Business and Operational Partners: Ecofleet may share data with trusted third-partyvendors that offer complementary products or services to users, such as:
○ Factoring companies and financial institutions for invoice financing andpayment processing,
○ Fuel card providers and fleet-management platforms for discount, tracking,and payment programs,
○ Insurance agencies and insurance providers for underwriting, policymanagement, or risk evaluation,
○ Fleet maintenance, compliance, and dispatch partners to improve operationalvisibility.
● Legal and Compliance Requirements: Ecofleet may disclose information if required bylaw, subpoena, or government investigation, or to enforce its own rights and contracts.
Ecofleet does not sell personal or company data to unrelated third parties.
You agree to:
1. Use the Services in compliance with all applicable FMCSA, DOT, and state regulations.
2. Ensure the accuracy of all data submitted, including logs and vehicle information.
3. Protect your account credentials and report any unauthorized use.
4. Not copy, resell, or modify the software or use it for unlawful purposes.
Ecofleet is built to comply with FMCSA ELD technical specifications. However, ultimateresponsibility for compliance rests with the motor carrier and driver.
Ecofleet is not liable for any violations, penalties, or fines resulting from incorrect or incompletedata entry, misuse of the device, or regulatory non-compliance.
Ecofleet aims to maintain continuous availability but does not guarantee uninterrupted service.
The company may update, suspend, or modify features at any time without prior notice formaintenance, security, or improvement.
The Services are provided “as is” and “as available.”
Ecofleet makes no express or implied warranties of merchantability, fitness for a particularpurpose, accuracy, or non-infringement.
Use of the platform is at your sole risk.
Ecofleet, its affiliates, employees, and agents shall not be liable for any:
● Indirect, incidental, or consequential damages,
● Loss of business, data, or revenue,
● Delays, service interruptions, or errors.
Total liability shall not exceed the total fees paid by you to Ecofleet in the preceding one (1) month.
You agree to indemnify and hold harmless Ecofleet and its affiliates from any claims, damages, losses, or legal costs arising from:
● Your use or misuse of the Services,
● Violation of laws or third-party rights,
● Inaccurate data submission or false reporting,
● Breach of these Terms.
All software, source code, designs, trademarks, and other materials on the platform are theintellectual property of Ecofleet or its licensors.
No rights or licenses are granted except as expressly provided in these Terms.
Your use of the Services is also governed by Ecofleet’s Privacy Policy, which explains howpersonal and operational data is collected, used, and protected.
By using Ecofleet, you acknowledge and consent to the practices described in that policy.
Ecofleet reserves the right to suspend or terminate access to any user account that violates these Terms or compromises the integrity or security of the platform, with or without prior notice.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict oflaw principles.
All disputes shall be resolved in the state or federal courts located in Sheridan County, WY.
